{"id":4939,"date":"2022-12-27T16:11:31","date_gmt":"2022-12-27T16:11:31","guid":{"rendered":"https:\/\/march\u00e9spublics.be\/index.php\/?p=4939"},"modified":"2022-12-27T17:02:55","modified_gmt":"2022-12-27T17:02:55","slug":"application-de-la-reglementation-des-marches-publics-aux-operations-immobilieres-publiques","status":"publish","type":"post","link":"https:\/\/march\u00e9spublics.be\/index.php\/application-de-la-reglementation-des-marches-publics-aux-operations-immobilieres-publiques\/","title":{"rendered":"Application de la r\u00e8glementation des march\u00e9s publics aux op\u00e9rations immobili\u00e8res publiques"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Application de la r\u00e8glementation des march\u00e9s publics aux op\u00e9rations immobili\u00e8res publiques<\/h2>\n\n\n\n<div style=\"height:44px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>L\u2019ann\u00e9e 2022 a \u00e9t\u00e9 riche dans le domaine du droit des march\u00e9s et contrats publics\u00a0!<\/p>\n<p>Parmi les d\u00e9cisions de jurisprudence importantes, on pointera un arr\u00eat tr\u00e8s int\u00e9ressant prononc\u00e9 le 1er juillet par le Conseil d\u2019\u00e9tat (n\u00b0 254.209), concernant l\u2019<b><u>application de la r\u00e8glementation des march\u00e9s publics aux op\u00e9rations immobili\u00e8res publiques.<\/u><\/b><\/p>\n<p>Dans cette affaire, la Ville de Ciney a organis\u00e9 une proc\u00e9dure de march\u00e9 public pour vendre un site immobilier (ancien stade de football) \u00e0 un op\u00e9rateur priv\u00e9, \u00e0 charge pour ce dernier d\u2019y concevoir, financer et construire des logements et espaces publics, r\u00e9pondant \u00e0 une programmation urbanistique pr\u00e9d\u00e9finie.<\/p>\n<p>Suite au recours d\u2019un candidat \u00e9vinc\u00e9, le Conseil d\u2019\u00e9tat a estim\u00e9 que si cette op\u00e9ration incluait diverses obligations d\u2019am\u00e9nagement urbanistiques \u00e0 charge du futur acqu\u00e9reur, ceci ne suffisait pas \u00e0 consid\u00e9rer qu\u2019il s\u2019agissait d\u2019un march\u00e9 public de travaux \u00ab\u00a0r\u00e9pondant aux besoins\u00a0\u00bb de la Commune. L\u2019\u00e9l\u00e9ment d\u00e9cisif retenu par le Conseil d\u2019\u00e9tat concerne le fait que la Commune ne devenait, \u00e0 la suite de cette op\u00e9ration, pas titulaire d\u2019un droit (r\u00e9el ou personnel) sur les immeubles \u00e0 construire (hormis sur certains accessoires), ce qui d\u00e9montrerait, \u00e0 l\u2019estime du Conseil d\u2019\u00e9tat, l\u2019absence d\u2019int\u00e9r\u00eat \u00e9conomique direct et de contrepartie, tel que requis par la jurisprudence europ\u00e9enne\u00a0:<\/p>\n<p><i>\u00ab\u00a0En l\u2019esp\u00e8ce, il n\u2019appara\u00eet pas que l\u2019op\u00e9ration litigieuse aurait \u00e9t\u00e9 con\u00e7ue pour r\u00e9pondre \u00e0 un besoin li\u00e9 au fonctionnement ou aux missions de la partie adverse. Par ailleurs, il n\u2019appara\u00eet ni que la partie adverse est appel\u00e9e \u00e0 devenir propri\u00e9taire des travaux ou de l\u2019ouvrage projet\u00e9 dans le cadre de l\u2019op\u00e9ration litigieuse, particuli\u00e8rement pour ce qui concerne les logements \u00e0 construire sur le terrain qui fait l\u2019objet de la vente, ni qu\u2019elle disposera d\u2019un titre juridique qui lui assurera la disponibilit\u00e9 des ouvrages concern\u00e9s. En toute hypoth\u00e8se, \u00e0 supposer qu\u2019il faille avoir \u00e9gard \u00e0 la r\u00e9trocession pr\u00e9vue en faveur de la partie adverse et que cette r\u00e9trocession conf\u00e8re \u00e0 la partie adverse un titre juridique \u00e0 l\u2019\u00e9gard des biens sur lesquels elle porte, il n\u2019est pas \u00e9tabli, dans le cadre de la pr\u00e9sente proc\u00e9dure en extr\u00eame urgence, que cet aspect de l\u2019op\u00e9ration repr\u00e9senterait l\u2019objet principal de celle-ci, au point de justifier la qualification de march\u00e9 public.\u00a0\u00bb<\/i><\/p>\n\n\n\n<p>Le Conseil d\u2019\u00e9tat conclut donc que les obligations impos\u00e9es \u00e0 l\u2019acqu\u00e9reur du site immobilier ne sont que de exigences et charges d\u2019urbanisme, impos\u00e9es dans l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.<\/p>\n\n\n\n<p>Cet arr\u00eat est d\u2019autant plus important que la Commune avait express\u00e9ment qualifi\u00e9 sa proc\u00e9dure de march\u00e9 public et qu\u2019aucun des plaideurs n\u2019avait remis en cause l\u2019application des march\u00e9s publics \u00e0 l\u2019op\u00e9ration, avant que le Conseil d\u2019\u00e9tat ne l\u2019invoque d\u2019office.<\/p>\n\n\n\n<p>Cette jurisprudence est certainement \u00e0 garder \u00e0 l\u2019esprit lorsque des pouvoirs adjudicateurs entreprennent des op\u00e9rations immobili\u00e8res
