Le montant de l’offre du soumissionnaire choisi s’\u00e9carte d’au moins 15% en-dessous de la moyenne des montants des offres d\u00e9pos\u00e9es par les soumissionnaires s\u00e9lectionn\u00e9s. Face \u00e0 cette situation, le pouvoir adjudicateur a choisi, comme le lui permet l’article 99, \u00a72, alin\u00e9a 3, 1\u00b0, de l’arr\u00eat\u00e9 royal du 15 juillet 2011, de motiver directement dans la d\u00e9cision d’attribution que le montant total de l’offre ne pr\u00e9sente pas de caract\u00e8re anormal, tout en affirmant qu’il n’a pas entendu inviter ce dernier \u00e0 fournir les justifications n\u00e9cessaires comme pr\u00e9vu \u00e0 l’article 21, \u00a73, alin\u00e9as 2 et 4, du m\u00eame arr\u00eat\u00e9 royal. Une telle fa\u00e7on de proc\u00e9der est acceptable pour autant que, en pr\u00e9sence d’une offre exigeant la v\u00e9rification de son montant total, le pouvoir adjudicateur dispose d’\u00e9l\u00e9ments probants pour justifier le caract\u00e8re normal du montant global de l’offre en question et \u00e9tablir que le pouvoir adjudicateur a bien, ce faisant, proc\u00e9d\u00e9 \u00e0 une v\u00e9rification s\u00e9rieuse de ces \u00e9l\u00e9ments et du caract\u00e8re normal du montant total de cette offre, en ex\u00e9cution de son devoir de minutie.<\/p>\n\n\n\n
