(Arr\u00eat n\u00b0 254.257 du 8&nbsp;juillet 2022, s.a. LESUCO)<\/p>\n\n\n\n<p class=\"has-text-align-left\">En l\u2019occurrence, la Commune de SAMBREVILLE avait exig\u00e9, dans un march\u00e9 public de travaux, que les soumissionnaires lui transmettent, au titre de la s\u00e9lection qualitative,&nbsp; une d\u00e9claration indiquant leurs effectifs moyens annuels avec comme niveau d\u2019exigence de disposer d\u2019un ratio chiffre d\u2019affaires annuel\/effectifs moyens annuels au maximum \u00e9gal \u00e0 500.000 euros par travailleur.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Ceci obligeait donc les soumissionnaires \u00e0 disposer d\u2019un nombre de travailleurs minimum, sur leur propre pay-roll. Ce faisant, les soci\u00e9t\u00e9s sans personnel ou avec un personnel tr\u00e8s r\u00e9duit, qui fonctionnent exclusivement avec des sous-traitants en cha\u00eene, ne pouvaient pas \u00eatre s\u00e9lectionn\u00e9es.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Nonobstant les contestations d\u2019un requ\u00e9rant contre un tel crit\u00e8re, le Conseil d\u2019\u00c9tat a jug\u00e9 qu\u2019un cahier sp\u00e9cial des charges peut imposer un ratio \u00ab chiffre d\u2019affaires\/effectifs \u00bb comme crit\u00e8re de s\u00e9lection qualitative pour combattre le dumping social, en excluant les soumissionnaires qui recourent de mani\u00e8re excessive \u00e0 la sous-traitance et s\u2019assurer, de la sorte, de la capacit\u00e9 technique et professionnelle des soumissionnaires \u00e0 ex\u00e9cuter le march\u00e9.<\/p>\n\n\n\n<p>Bien s\u00fbr, cette exigence de s\u00e9lection qualitative n\u2019emp\u00eache pas qu\u2019un soumissionnaire puisse faire appel \u00e0 la capacit\u00e9 de tiers, mais il conviendra que ceux-ci puissent eux-m\u00eames remplir cette exigence ce qui ne sera pas \u00e9vident.<\/p>\n\n\n\n<p>Les pouvoirs adjudicateurs pourraient s\u2019inspirer de cet exemple dans leurs futurs march\u00e9s pour lutter contre le dumping social.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Les services financiers de pr\u00eats accord\u00e9s par les institutions bancaires ne sont pas des services soumis \u00e0 la r\u00e8glementation des march\u00e9s publics.
