Si certaines des r\u00e9f\u00e9rences prohib\u00e9es par l’article 8, \u00a72, alin\u00e9a 1er, de l’arr\u00eat\u00e9 royal du 15 juillet 2011 tels \u00ab\u00a0une marque\u00a0\u00bb, \u00ab\u00a0un brevet\u00a0\u00bb ou \u00ab\u00a0une origine (…) d\u00e9termin\u00e9e\u00a0\u00bb ne laissent gu\u00e8re de place \u00e0 l’interpr\u00e9tation, il n’en va pas n\u00e9cessairement de m\u00eame pour d’autres, \u00e0 la port\u00e9e plus g\u00e9n\u00e9rale, tels le \u00ab\u00a0type\u00a0\u00bb ou \u00ab\u00a0le proc\u00e9d\u00e9 particulier\u00a0\u00bb. En \u00e9num\u00e9rant cette vari\u00e9t\u00e9 d’hypoth\u00e8ses, en des termes parfois assez g\u00e9n\u00e9raux, cette disposition ne se limite donc pas \u00e0 cibler certains cas ais\u00e9ment identifiables de limitation de la concurrence, mais interdit, plus largement, de recourir \u00e0 des sp\u00e9cifications qui seraient d\u00e9finies par rapport \u00e0 une solution technique permettant d’atteindre un r\u00e9sultat et non par ce r\u00e9sultat lui-m\u00eame. Le rapport au Roi explicite de mani\u00e8re positive cette interdiction en indiquant que \u00ab\u00a0les sp\u00e9cifications techniques doivent pouvoir \u00eatre \u00e9tablies en termes de performances et d’exigences fonctionnelles\u00a0\u00bb. Il s’ensuit que lorsque la qualification d’une sp\u00e9cification pr\u00eate lieu \u00e0 discussion, la question qu’il convient de se poser tient \u00e0 savoir si elle d\u00e9termine une performance \u00e0 atteindre ou une exigence fonctionnelle, ou si elle impose, en r\u00e9alit\u00e9, une solution technique d\u00e9termin\u00e9e pour parvenir \u00e0 cette performance ou r\u00e9pondre \u00e0 cette exigence fonctionnelle.<\/p>\n\n\n\n
