En outre, les deux lots font partie du m\u00eame march\u00e9 et l’entente a aussi pour objet la r\u00e9partition de ce march\u00e9 entre les soci\u00e9t\u00e9s concern\u00e9es, l’une soumissionnant pour le lot 1 et l’autre pour le lot 2. La possibilit\u00e9 l\u00e9gale qu’elles choisissent chacune de ne soumissionner que relativement \u00e0 un lot n’est pas de nature \u00e0 exclure l’entente quand ce choix est concert\u00e9. Une telle pratique est de nature \u00e0 fausser les conditions normales de la concurrence puisqu’elle tend \u00e0 limiter le choix de l’autorit\u00e9 relativement \u00e0 chacun des lots tant en ce qui concerne le nombre de concurrents que les conditions du march\u00e9. En \u00e9cartant l’offre de la soci\u00e9t\u00e9 requ\u00e9rante, le pouvoir adjudicateur n’a pas viol\u00e9 l’article 9 de la loi du 15 juin 2006 ni l’article 23 de l’arr\u00eat\u00e9 royal du 15 juillet 2011.<\/p>\n\n\n\n
