Il n’en reste pas moins que, m\u00eame dans une proc\u00e9dure n\u00e9goci\u00e9e, les candidatures doivent \u00eatre conformes au cahier sp\u00e9cial des charges et aux prescriptions qui y sont contenues et que le fait de maintenir une candidature irr\u00e9guli\u00e8re dans la proc\u00e9dure n\u00e9goci\u00e9e, de m\u00eame que le fait d’\u00e9carter \u00e0 tort une candidature alors que celle-ci est r\u00e9guli\u00e8re, sont contraires au principe d’\u00e9galit\u00e9 entre candidats soumissionnaires, au principe de transparence et au principe patere legem quam ipse fecisti. D\u00e8s lors, en proc\u00e9dure n\u00e9goci\u00e9e, comme en appel d’offres ou en adjudication, le pouvoir adjudicateur ne peut pas attribuer le march\u00e9 \u00e0 une offre d\u00e9rogeant \u00e0 une disposition du cahier sp\u00e9cial des charges qui est essentielle, soit par d\u00e9termination expresse par le pouvoir adjudicateur dans les documents du march\u00e9, soit par nature.<\/p>\n\n\n\n
