L’article 1er, 4 de la directive 2004\/18\/CE du Parlement europ\u00e9en et du Conseil du 31 mars 2004 relative \u00e0 la coordination des proc\u00e9dures de passation des march\u00e9s publics de travaux, de fournitures et de services, d\u00e9finit la concession de services comme \u00e9tant un \u00ab\u00a0contrat pr\u00e9sentant les m\u00eames caract\u00e9ristiques qu’un march\u00e9 public de services, \u00e0 l’exception du fait que la contrepartie de la prestation des services consiste soit uniquement dans le droit d’exploiter le service, soit dans ce droit assorti d’un prix\u00a0\u00bb. Les prestations qui font l’objet de la concession de service sont con\u00e7ues \u00e0 tout le moins au b\u00e9n\u00e9fice d’usagers dont les int\u00e9r\u00eats \u00e9conomiques, dans le cadre de cette op\u00e9ration, diff\u00e8rent de l’int\u00e9r\u00eat de l’autorit\u00e9 qui conc\u00e8de l’exploitation du service, m\u00eame si cet int\u00e9r\u00eat propre \u00e0 l’autorit\u00e9 peut \u00e9galement \u00eatre servi par ladite op\u00e9ration. Lorsqu’un service d’aide \u00e0 la gestion de cuisines de collectivit\u00e9 ne pourvoit pas aux besoins d’usagers que sont les personnes auxquelles sont destin\u00e9s les repas pr\u00e9par\u00e9s dans lesdites cuisines, mais bien aux besoins de l’institution qui g\u00e8re celles-ci, la qualification de \u00ab\u00a0concession de service\u00a0\u00bb dont se pr\u00e9vaut le pouvoir adjudicateur ne peut, en cons\u00e9quence, \u00eatre retenue.<\/p>\n\n\n\n
