La jurisprudence de la Cour de Justice de l’Union europ\u00e9enne est fix\u00e9e en ce sens que, lorsqu’un contrat contient \u00e0 la fois des \u00e9l\u00e9ments ayant trait \u00e0 un march\u00e9 public de travaux et des \u00e9l\u00e9ments ayant trait \u00e0 un autre type de march\u00e9, c’est l’objet principal du contrat qui d\u00e9termine sa qualification, laquelle doit \u00eatre op\u00e9r\u00e9e \u00ab\u00a0au regard des obligations essentielles qui pr\u00e9valent et qui, comme telles, caract\u00e9risent ce march\u00e9, par opposition \u00e0 celles qui ne rev\u00eatent qu’un caract\u00e8re accessoire ou compl\u00e9mentaire et sont impos\u00e9es par l’objet m\u00eame du contrat, le montant respectif des diff\u00e9rentes prestations en pr\u00e9sence n’\u00e9tant, \u00e0 cet \u00e9gard, qu’un crit\u00e8re parmi d’autres \u00e0 prendre en compte aux fins de ladite d\u00e9termination\u00a0\u00bb (cf. notamment C.J.U.E., aff.
