Les candidats ou soumissionnaires peuvent faire appel \u00e0 la capacit\u00e9 technique et professionnelle d’entit\u00e9s tierces pour r\u00e9pondre aux crit\u00e8res de s\u00e9lection d’un march\u00e9 public. Il convient toutefois, pour ce faire, de respecter les conditions de l’article 150 de la loi du 17 juin 2016 relative aux march\u00e9s publics et de l’article 72, \u00a7 2, de l’arr\u00eat\u00e9 royal du 18 juin 2017 relatif \u00e0 la passation des march\u00e9s publics dans les secteurs sp\u00e9ciaux. Il r\u00e9sulte des dispositions pr\u00e9cit\u00e9es qu’une soci\u00e9t\u00e9, qui a soumissionn\u00e9 seule \u00e0 un march\u00e9 dans lequel la sous-traitance \u00e9tait express\u00e9ment interdite, ne pouvait se pr\u00e9valoir de la capacit\u00e9 technique et professionnelle d’une entit\u00e9 tierce disposant de l’autorisation impos\u00e9e par l’article 16 de la loi du 2 octobre 2017. Le fait que cette entit\u00e9 tierce soit majoritairement d\u00e9tenue par une soci\u00e9t\u00e9 du m\u00eame groupe que le soumissionnaire ne dispense pas du respect des conditions formul\u00e9es par ces dispositions.<\/p>\n\n\n\n
