Il convient n\u00e9anmoins de d\u00e9terminer si Infrabel a r\u00e9guli\u00e8rement pu consid\u00e9rer que seul le produit Premium de la soci\u00e9t\u00e9 requ\u00e9rante pouvait \u00eatre qualifi\u00e9 pour un certain lot, \u00e0 l’exclusion de son produit Innostrail. Il r\u00e9sulte des diff\u00e9rentes d\u00e9cisions reconnaissant ou prolongeant la qualification des produits de la soci\u00e9t\u00e9 requ\u00e9rante que cette qualification \u00ab\u00a0est bas\u00e9e sur le dossier produit\u00a0\u00bb par elle. Or, il ressort de son propre dossier soumis pour qualification que son produit Innostrail est pr\u00e9vu pour la circulation \u00ab\u00a0mais en fr\u00e9quence faible\u00a0\u00bb et que l’utilisation principale de celui-ci concerne \u00ab\u00a0la travers\u00e9e de v\u00e9hicules en gare de formation, passages \u00e0 niveau d’acc\u00e8s d’engins dans tunnel et routes de campagne\u00a0\u00bb, alors que son produit Premium est \u00ab\u00a0pr\u00e9vu pour la circulation de voitures, camions en utilisation standard ou fr\u00e9quence plus importante\u00a0\u00bb. Ainsi, la soci\u00e9t\u00e9 requ\u00e9rante n’a pu raisonnablement croire que son produit Innostrail \u00e9tait qualifi\u00e9 pour le syst\u00e8me C alors qu’elle-m\u00eame renseigne dans son dossier que l’utilisation principale de ce produit est pr\u00e9vu pour une circulation de fr\u00e9quence faible.<\/p>\n\n\n\n
