L’utilisation d’un avis sur l’existence d’un syst\u00e8me de qualification comme moyen d’appel \u00e0 la concurrence a pour effets, d’une part, que les participants aux march\u00e9s sp\u00e9cifiques couverts par le syst\u00e8me de qualification seront s\u00e9lectionn\u00e9s parmi les candidats d\u00e9j\u00e0 qualifi\u00e9s selon un tel syst\u00e8me et, d’autre part, que, pour ces march\u00e9s sp\u00e9cifiques, l’entit\u00e9 adjudicatrice sera dispens\u00e9e de publier un avis de march\u00e9. Il se d\u00e9duit de l’ensemble form\u00e9 par les articles 140 et 148 de la loi du 17 juin 2016 et de la n\u00e9cessit\u00e9, \u00e0 laquelle cet ensemble pourvoit, de garantir les principes inscrits \u00e0 l’article 4 de la loi, que l’entit\u00e9 adjudicatrice ne peut se pr\u00e9valoir de ces deux effets de l’utilisation d’un avis sur l’existence d’un syst\u00e8me de qualification comme moyen d’appel \u00e0 la concurrence, qu’\u00e0 la condition d’avoir clairement manifest\u00e9 son choix d’assigner un tel but \u00e0 la publication de cet avis sp\u00e9cifique, dans le respect des conditions et formalit\u00e9s prescrites \u00e0 cette fin.<\/p>\n\n\n\n
