Le rapport pr\u00e9cise, \u00e0 cet \u00e9gard, que \u00ab Le nombre d’heures minimum pour le nettoyage du site a \u00e9t\u00e9 nettement sur\u00e9valu\u00e9\u00bb. Sans qu’il ne soit besoin \u00e0 ce stade de d\u00e9terminer si le rapport d’analyse des offres contient un ou deux motifs justifiant la d\u00e9cision attaqu\u00e9e, il suffit de constater que ce ou ces motifs repose(nt) sur la pr\u00e9misse que le nombre d’heures pour le nettoyage a \u00e9t\u00e9 sur\u00e9valu\u00e9. Dans une telle hypoth\u00e8se, le dossier administratif doit contenir les \u00e9l\u00e9ments sur lesquels le pouvoir adjudicateur s’est fond\u00e9 pour arriver \u00e0 une telle conclusion. Le simple constat que les offres ont proc\u00e9d\u00e9 \u00e0 une modification de ce nombre d’heures ne permet pas \u00e0 lui seul d’\u00e9tablir que le nombre d’heures pr\u00e9vu est \u00ab\u00a0nettement sur\u00e9valu\u00e9\u00a0\u00bb. Il en va de m\u00eame de la r\u00e9f\u00e9rence \u00e0 la surface \u00e0 nettoyer. La seule indication donn\u00e9e \u00e0 l’audience selon laquelle la superficie serait inf\u00e9rieure \u00e0 100 m\u00b2 ne peut pallier cette absence de tout \u00e9l\u00e9ment concret dans le dossier administratif. Ce dernier ne contenant aucun \u00e9l\u00e9ment permettant d’\u00e9tablir la r\u00e9alit\u00e9 de la pr\u00e9misse du raisonnement de la d\u00e9cision de renonciation, le moyen est s\u00e9rieux.<\/p>\n\n\n\n
