Il ressort notamment de l’article 36 de l’arr\u00eat\u00e9 royal du 18 avril 2017 relatif \u00e0 la passation des march\u00e9s publics dans les secteurs classiques que les justifications de prix fournies par un soumissionnaire \u00e0 la demande du pouvoir adjudicateur sont soumises \u00e0 l’appr\u00e9ciation de celui-ci, laquelle appr\u00e9ciation suppose – notamment pour l’application de l’article 36, \u00a7 3 – un examen concret et effectif de ces justifications. La r\u00e9alit\u00e9 et l’effectivit\u00e9 de cet examen doivent ressortir \u00e0 suffisance de la d\u00e9cision d’attribution du march\u00e9 ou, \u00e0 tout le moins, du dossier administratif.<\/p>\n\n\n\n
