Lorsqu’il r\u00e9sulte clairement du rapport d’analyse des offres que le pouvoir adjudicateur s’est bien livr\u00e9 \u00e0 une v\u00e9rification effective des prix, il n’appartient pas au Conseil d’\u00c9tat de substituer son appr\u00e9ciation \u00e0 celle du pouvoir adjudicateur, son contr\u00f4le \u00e9tant, \u00e0 cet \u00e9gard, limit\u00e9 aux erreurs de fait et aux erreurs manifestes d’appr\u00e9ciation. L’existence d’une diff\u00e9rence importante entre les prix n’\u00e9tablit, toutefois, pas \u00e0 elle seule que le pouvoir adjudicateur aurait commis une erreur manifeste d’appr\u00e9ciation en consid\u00e9rant tous ces prix comme n’apparaissant pas anormaux. Au surplus, l’objet d’une v\u00e9rification des prix n’est pas d’expliquer les raisons d’un \u00e9cart qui existerait entre diff\u00e9rents soumissionnaires, mais bien de s’assurer de ce que le prix propos\u00e9 dans chaque offre peut garantir une ex\u00e9cution du march\u00e9 conforme aux exigences \u00e9dict\u00e9es par les documents du march\u00e9 et aux prestations propos\u00e9es par les soumissionnaires en excluant toute sp\u00e9culation au d\u00e9triment des int\u00e9r\u00eats fondamentaux du pouvoir adjudicateur et des deniers publics.<\/p>\n\n\n\n
