Le pouvoir adjudicateur a pu, sans commettre d’erreur manifeste d’appr\u00e9ciation, d\u00e9cider de ne pas proc\u00e9der \u00e0 un contr\u00f4le de prix apparemment anormaux, sur pied de l’article 36 de l’arr\u00eat\u00e9 royal du 18 avril 2017 d\u00e8s lors que son analyse s’appuie sur un tableau comparatif dans lequel les prix unitaires des diff\u00e9rents soumissionnaires ont syst\u00e9matiquement \u00e9t\u00e9 relev\u00e9s, que les prix d\u00e9pos\u00e9s sont globalement proches du prix de r\u00e9f\u00e9rence que le pouvoir adjudicateur a fix\u00e9 au terme de la phase de prospection du march\u00e9, apr\u00e8s avoir consult\u00e9 un grand nombre d’entreprises actives dans le domaine du textile et que le prix moyen des offres r\u00e9guli\u00e8res qui ont \u00e9t\u00e9 remises est de 2.3 euros\/pi\u00e8ce et celui de l’ensemble des offres de 2.1 euros\/pi\u00e8ce. La soci\u00e9t\u00e9 requ\u00e9rante ne convainc pas lorsqu’elle prend, comme \u00e9talon de r\u00e9f\u00e9rence, les prix qu’elle a elle-m\u00eame propos\u00e9s alors que ceux-ci sont nettement inf\u00e9rieurs aux prix offerts par la grande majorit\u00e9 des soumissionnaires. Son offre a, par ailleurs, \u00e9t\u00e9 estim\u00e9e irr\u00e9guli\u00e8re en raison d’une d\u00e9rogation au sch\u00e9ma de livraison et de l’exigence d’un acompte de 30% sur les montants dus. Il n’est pas exclu que, par ces dispositifs, elle ait entendu limiter son risque financier ou se m\u00e9nager des conditions plus favorables et, en cons\u00e9quence, pu proposer des prix sensiblement inf\u00e9rieurs aux autres soumissionnaires.<\/p>\n\n\n\n
