D&rsquo;une part, elle n&rsquo;affecte pas, par elle-m\u00eame, les prix de l&rsquo;offre. Les propositions de modifications de quantit\u00e9s ne sont susceptibles d&rsquo;avoir un impact sur les prix que parce qu&rsquo;elles figurent dans la note justificative jointe \u00e0 l&rsquo;offre et \u00e0 la condition d&rsquo;\u00eatre accept\u00e9es par le pouvoir adjudicateur. D&rsquo;autre part, il n&rsquo;appara\u00eet pas des documents du march\u00e9 que l&rsquo;interdiction de modifier directement les quantit\u00e9s dans le m\u00e9tr\u00e9 constituerait une exigence essentielle ou qu&rsquo;elle serait prescrite \u00e0 peine de nullit\u00e9. Cette erreur n&rsquo;apporte, par ailleurs, aucun avantage \u00e0 la soci\u00e9t\u00e9 choisie ni n&#8217;emp\u00eache de comparer les offres entre elles, puisque, conform\u00e9ment au cahier sp\u00e9cial des charges, le pouvoir adjudicateur ne peut prendre en consid\u00e9ration que les modifications qui sont propos\u00e9es dans la note annex\u00e9e \u00e0 l&rsquo;offre, la soci\u00e9t\u00e9 requ\u00e9rante ayant elle-m\u00eame sugg\u00e9r\u00e9, dans sa propre note, des corrections de quantit\u00e9s du m\u00e9tr\u00e9. Enfin, la rectification de l&rsquo;erreur op\u00e9r\u00e9e en application de l&rsquo;article 34, paragraphe 2, de l&rsquo;arr\u00eat\u00e9 royal du 18 avril 2017, ne d\u00e9roge pas, non plus, au principe d&rsquo;intangibilit\u00e9 des offres puisque les propositions de modifications de quantit\u00e9s formul\u00e9es par la soci\u00e9t\u00e9 choisie sont clairement indiqu\u00e9es dans la note justificative qui fait partie de l&rsquo;offre d\u00e9pos\u00e9e.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>L&rsquo;erreur de manipulation commise, soit le fait d&rsquo;avoir report\u00e9 les propositions de notification de quantit\u00e9s directement dans le m\u00e9tr\u00e9, ne constitue pas une irr\u00e9gularit\u00e9 substantielle.
