Les d\u00e9cisions attaqu\u00e9es se r\u00e9f\u00e8rent explicitement \u00e0 la proc\u00e9dure ouverte dans le cadre de laquelle \u00ab\u00a0seules des offres irr\u00e9guli\u00e8res ont \u00e9t\u00e9 pr\u00e9sent\u00e9es\u00a0\u00bb ainsi qu’aux d\u00e9cisions motiv\u00e9es de non-attribution lesquelles mentionnent qu’ \u00ab\u00a0\u00e0 l’issue de la v\u00e9rification op\u00e9r\u00e9e, certains prix propos\u00e9s semblent anormaux\u00a0\u00bb, identifient clairement les postes concern\u00e9s, pr\u00e9cisent que \u00ab\u00a0vu la nature et les quantit\u00e9s pr\u00e9vues, les postes concern\u00e9s peuvent \u00eatre consid\u00e9r\u00e9s comme non n\u00e9gligeables\u00a0\u00bb et donnent les motifs pour lesquels les justifications apport\u00e9es ne permettent pas d’expliquer les prix anormalement hauts propos\u00e9s pour ces postes. Les d\u00e9cisions attaqu\u00e9es font ensuite \u00e9tat de ce que l’ensemble des prix propos\u00e9s par la soci\u00e9t\u00e9 requ\u00e9rante sont identiques \u00e0 ceux pr\u00e9sent\u00e9s lors de la proc\u00e9dure ouverte, alors que \u00ab\u00a0les offres remises dans le cadre de la proc\u00e9dure ouverte ont \u00e9t\u00e9 \u00e9cart\u00e9es pour cause d’irr\u00e9gularit\u00e9 substantielle conform\u00e9ment \u00e0 l’article 36, paragraphe 3, 1\u00b0 et 76 de l’arr\u00eat\u00e9 royal du 18 avril 2017 en raison du caract\u00e8re anormal de certains prix\u00a0\u00bb pour conclure que \u00ab\u00a0l’offre de la requ\u00e9rante n’ayant pas \u00e9t\u00e9 adopt\u00e9e, elle doit \u00e0 nouveau \u00eatre \u00e9cart\u00e9e pour cause d’irr\u00e9gularit\u00e9 substantielle conform\u00e9ment \u00e0 l’article 76 de l’arr\u00eat\u00e9 royal du 18 avril 2017 en raison du caract\u00e8re anormal de certains prix\u00a0\u00bb. Par cons\u00e9quent, la soci\u00e9t\u00e9 requ\u00e9rante ne peut soutenir \u00e0 la lecture des d\u00e9cisions attaqu\u00e9es et des d\u00e9cisions de non-attribution qui lui ont \u00e9t\u00e9 pr\u00e9alablement communiqu\u00e9es et auxquelles les d\u00e9cisions attaqu\u00e9es renvoient, qu’elle n’\u00e9tait pas en mesure d’identifier les postes non n\u00e9gligeables des offres qui pr\u00e9sentaient des prix anormalement \u00e9lev\u00e9s ainsi que les raisons pour lesquelles les justifications qu’elle a remises n’ont pas \u00e9t\u00e9 accept\u00e9es, ni de comprendre pourquoi ses offres ont \u00e9t\u00e9 \u00e9cart\u00e9es pour cause d’irr\u00e9gularit\u00e9.<\/p>\n\n\n\n
