L’article 36, paragraphe 4, de l’arr\u00eat\u00e9 royal du 18 avril 2017 pr\u00e9voit un r\u00e9gime particulier en mati\u00e8re de v\u00e9rification des prix ou des co\u00fbts apparemment anomaux, qui porte sur le montant total des offres. Cet examen est obligatoire pour tous les march\u00e9s de travaux et pour certains march\u00e9s de services \u00ab\u00a0dans un secteur sensible \u00e0 la fraude\u00a0\u00bb, d\u00e9fini \u00e0 l’article 2, 13\u00b0, de l’arr\u00eat\u00e9 royal, d\u00e8s lors notamment que ces march\u00e9s sont pass\u00e9s par proc\u00e9dure ouverte, le prix est le seul crit\u00e8re d’attribution et quatre offres au moins sont prises en consid\u00e9ration. Dans ce cas, il est pr\u00e9vu que \u00ab\u00a0le pouvoir adjudicateur effectue un examen des prix ou des co\u00fbts conform\u00e9ment aux paragraphes 2 et 3\u00a0\u00bb pour toute offre dont le montant s’\u00e9carte d’au moins quinze pour cent en dessous du montant de la moyenne des offres s\u00e9lectionn\u00e9es, en excluant l’offre la plus basse et l’offre la plus \u00e9lev\u00e9e, lorsque le nombre de ces offres est inf\u00e9rieur \u00e0 sept. Dans le rapport au Roi, il est pr\u00e9cis\u00e9 que \u00ab\u00a0le pouvoir adjudicateur peut constater, dans une seule et m\u00eame offre, qu’un (ou plusieurs) poste(s) non n\u00e9gligeable(s) pr\u00e9sente(nt) un caract\u00e8re anormal, de m\u00eame que le montant total de l’offre\u00a0\u00bb.<\/p>\n\n\n\n
