Si l’article 34, paragraphe 2, de l’arr\u00eat\u00e9 royal du 18 avril 2017 n’indique pas ce qu’il convient d’entendre par une erreur mat\u00e9rielle, il se d\u00e9duit de l’obligation de rechercher l’intention r\u00e9elle du soumissionnaire comme de l’interdiction de modifier l’offre, que l’erreur mat\u00e9rielle doit s’entendre comme celle qui a manifestement pour effet d’aboutir \u00e0 un r\u00e9sultat contraire \u00e0 celui qu’entendait poursuivre le soumissionnaire. Lorsqu’il est question d’une erreur mat\u00e9rielle ou d’une erreur purement mat\u00e9rielle, le pouvoir adjudicateur dispose d’une libert\u00e9 d’appr\u00e9ciation pour d\u00e9terminer, \u00e0 la lumi\u00e8re des circonstances, s’il est admissible qu’il s’agisse d’une erreur mat\u00e9rielle et si, lorsqu’il a commis l’erreur, l’intention du soumissionnaire \u00e9tait claire ou non.
