L’offre remise par la soci\u00e9t\u00e9 requ\u00e9rante ne permet pas d’y appliquer l’article 86, paragraphe 2, de l’arr\u00eat\u00e9 royal du 18 avril 2017 d\u00e8s lors que cette offre ne contient aucune omission de prix qui puisse \u00eatre corrig\u00e9e sur la base de cette disposition, la \u00ab\u00a0ristourne\u00a0\u00bb contenue dans l’offre ne r\u00e9sultant pas de \u00ab\u00a0prix omis pour certains postes\u00a0\u00bb mais d’un choix d\u00e9lib\u00e9r\u00e9, clairement expliqu\u00e9 dans l’offre. Tous les postes concern\u00e9s se sont vu attribuer, dans un premier temps, des prix qui figurent dans le borderau d\u00e9taill\u00e9. Ces postes et les prix correspondants sont, dans un second temps, clairement identifi\u00e9s comme \u00e9tant retir\u00e9s pour des \u00ab\u00a0raisons budg\u00e9taires\u00a0\u00bb et, dans une moindre mesure, dans un objectif d’ \u00ab\u00a0am\u00e9liorations budg\u00e9taires\/modifications architecturales\u00a0\u00bb. La soci\u00e9t\u00e9 requ\u00e9rante confirme, elle-m\u00eame, dans sa requ\u00eate, que tous les prix figuraient bien dans leur offre, en sorte qu’il ne saurait \u00eatre question de prix omis pour certains postes, au sens de l’article 86, paragraphe 2, pr\u00e9cit\u00e9. En cons\u00e9quence, le moyen qui reproche au pouvoir adjudicateur d’avoir choisi de faire application de cette disposition avant de finalement consid\u00e9rer qu’elle n’\u00e9tait pas applicable n’est pas s\u00e9rieux.<\/p>\n\n\n\n
