Il n’appara\u00eet pas qu’il a dispos\u00e9 de l’ensemble des \u00e9l\u00e9ments utiles lui permettant de comprendre les prix propos\u00e9s et de contr\u00f4ler concr\u00e8tement leur normalit\u00e9. Par ailleurs, la m\u00e9thode appliqu\u00e9e par le pouvoir adjudicateur ne rend pas compte de ce qu’il aurait v\u00e9rifi\u00e9 que les prix offerts excluent toute sp\u00e9culation ou ne sont pas de nature \u00e0 porter atteinte \u00e0 une saine concurrence, alors que les taux de commission remis pr\u00e9sentent des \u00e9carts importants et les soumissionnaires des caract\u00e9ristiques tr\u00e8s diff\u00e9rentes. Le pouvoir adjudicateur s’est limit\u00e9 \u00e0 contr\u00f4ler que des \u00ab\u00a0montants\u00a0\u00bb, qui ne sont pas repr\u00e9sentatifs des prix effectivement propos\u00e9, permettaient de couvrir la \u00ab\u00a0charge salariale\u00a0\u00bb qu’implique, \u00e0 son estime, l’ex\u00e9cution du march\u00e9. Une telle mani\u00e8re d’op\u00e9rer est contraire aux r\u00e8gles relatives au contr\u00f4le des prix et des co\u00fbts et proc\u00e8de d’une erreur manifeste d’appr\u00e9ciation. Quant \u00e0 l’affirmation selon laquelle les taux de commission remis par les soumissionnaires constitueraient des postes n\u00e9gligeables, elle ne convainc pas. En effet, ce poste repr\u00e9sente 6.7% des recettes totales g\u00e9n\u00e9r\u00e9es par l’ex\u00e9cution du march\u00e9. Un tel pourcentage ne para\u00eet pas r\u00e9pondre \u00e0 la notion de poste d’une importance n\u00e9gligeable. C’est d’autant le cas que le taux de commission remis pour le recouvrement amiable des cr\u00e9ances exerce une influence d\u00e9terminante pour l’attribution du march\u00e9 et que ce taux repr\u00e9sente le seul prix propos\u00e9 par les soumissionnaires, ceux-ci n’\u00e9tant pas invit\u00e9s \u00e0 remettre d’autres prix dans leurs offres.<\/p>\n\n\n\n
