Dans le cadre de la pr\u00e9sente proc\u00e9dure, le pouvoir adjudicateur a laiss\u00e9 entendre que, pour l’appr\u00e9ciation du caract\u00e8re non n\u00e9gligeable des postes concern\u00e9s, devait \u00eatre relativis\u00e9e l’importance de l’impact financier de ceux-ci, cet indice devant \u00eatre combin\u00e9 avec d’autres. Elle a vis\u00e9 l’incidence des rendements trop \u00e9lev\u00e9s dont aurait rendu compte la soci\u00e9t\u00e9 requ\u00e9rante sur la bonne ex\u00e9cution du march\u00e9. Sans qu’il soit n\u00e9cessaire, \u00e0 ce stade, d’appr\u00e9cier la pertinence d’un tel indice dans l’appr\u00e9ciation du caract\u00e8re n\u00e9gligeable, ou non, de postes pour lesquels des prix unitaires ont \u00e9t\u00e9 jug\u00e9s anormaux, il suffit de constater que rien, dans la motivation de la d\u00e9cision d’attribution ou dans les pi\u00e8ces de la proc\u00e9dure, ne permet de constater que le pouvoir adjudicateur aurait tenu compte, pour fonder sa d\u00e9cision de consid\u00e9rer les postes litigieux comme non n\u00e9gligeables, de l’incidence de rendements trop \u00e9lev\u00e9s sur l’ex\u00e9cution du march\u00e9. En faisant grand cas des motifs de la d\u00e9cision d’attribution qui attesteraient des risques quant \u00e0 cette ex\u00e9cution du march\u00e9, le pouvoir adjudicateur para\u00eet confondre, quant \u00e0 leurs motifs respectifs, la d\u00e9cision de d\u00e9clarer anormaux les prix unitaires litigieux, avec celle par laquelle elle consid\u00e8re comme non n\u00e9gligeables les postes pour lesquels ces prix unitaires sont ainsi jug\u00e9s anormaux. La combinaison d’indices ne peut s\u00e9rieusement \u00eatre invoqu\u00e9e pour justifier la d\u00e9cision d’attribution.<\/p>\n\n\n\n
