S’agissant des postes pour lesquels s’est pos\u00e9e la question du caract\u00e8re anormalement bas du prix, les documents du march\u00e9 ne pr\u00e9voient pas la revente des d\u00e9chets concern\u00e9s, ni m\u00eame la possibilit\u00e9 d’une telle revente, mais seulement leur mise en C.T.A. ou en site autoris\u00e9, m\u00eame si lesdits d\u00e9chets sont valorisables. En acceptant la justification de prix avanc\u00e9e par la soci\u00e9t\u00e9 choisie (selon laquelle elle proc\u00e9derait \u00e0 la revente desdits d\u00e9chets), le pouvoir adjudicateur a donc accept\u00e9 que l’offre de cette derni\u00e8re s’\u00e9carte des prescriptions contenues dans les documents du march\u00e9. Il peut \u00eatre consid\u00e9r\u00e9 qu’il s’agit d’une irr\u00e9gularit\u00e9 de nature \u00e0 emp\u00eacher une comparaison effective des offres et \u00e0 donner un avantage discriminatoire \u00e0 la soci\u00e9t\u00e9 choisie, voire \u00e0 entra\u00eener une distorsion de concurrence. Une telle irr\u00e9gularit\u00e9 para\u00eet rev\u00eatir un caract\u00e8re substantiel au sens de l’article 76, \u00a71er, de l’arr\u00eat\u00e9 royal du 18 avril 2017. Partant, il incombait \u00e0 l’autorit\u00e9 d’\u00e9carter l’offre pour irr\u00e9gularit\u00e9.<\/p>\n\n\n\n
