Il ressort des documents du march\u00e9 que le pouvoir adjudicateur ne prescrivait pas la production de l’annexe 5 \u00e0 l’appui de l’offre et lors de son d\u00e9p\u00f4t, \u00e0 peine de nullit\u00e9 de celle-ci. Le pouvoir adjudicateur ne soutient, par ailleurs, pas que l’irr\u00e9gularit\u00e9 qu’il a d\u00e9cel\u00e9e dans l’offre rel\u00e8verait d’une des hypoth\u00e8ses vis\u00e9es \u00e0 l’article 76, alin\u00e9a 4, de l’arr\u00eat\u00e9 royal du 18 avril 2017, qui autoriserait \u00e0 la pr\u00e9sumer substantielle. Dans ces circonstances, le pouvoir adjudicateur devait, pour qualifier de \u00ab\u00a0substantielle\u00a0\u00bb l’irr\u00e9gularit\u00e9 reproch\u00e9e \u00e0 l’offre, v\u00e9rifier qu’elle \u00e9tait de nature \u00e0 produire l’un des effets que vise l’article 76, paragraphe 1er, alin\u00e9a 3, \u00e0 savoir de donner un avantage discriminatoire au soumissionnaire, entra\u00eener une distorsion de concurrence, emp\u00eacher l’\u00e9valuation de l’offre du soumissionnaire ou la comparaison de celle-ci aux autres offres, ou rendre inexistant, incomplet ou incertain l’engagement du soumissionnaire \u00e0 ex\u00e9cuter le march\u00e9 dans les conditions pr\u00e9vues. La lecture de la motivation de la d\u00e9cision d’attribution relative \u00e0 cet aspect ne permet ni de v\u00e9rifier que le pouvoir adjudicateur a effectivement proc\u00e9d\u00e9 \u00e0 la v\u00e9rification \u00e0 laquelle il \u00e9tait tenu, ni de comprendre ce qui l’a d\u00e9termin\u00e9 \u00e0 qualifier de \u00ab\u00a0substantielle\u00a0\u00bb l’irr\u00e9gularit\u00e9 reproch\u00e9e, la d\u00e9cision d’attribution se bornant \u00e0 \u00e9noncer que l’offre est entach\u00e9e d’une irr\u00e9gularit\u00e9 substantielle. Les d\u00e9veloppements d’\u00e9crits de proc\u00e9dure ne peuvent pallier l’insuffisance de la motivation de la d\u00e9cision d’attribution. En tant qu’il invoque la m\u00e9connaissance des obligations de motivation formelle qui incombait au pouvoir adjudicateur en d\u00e9cidant que l’offre \u00e9tait entach\u00e9e d’irr\u00e9gularit\u00e9 substantielle, le moyen est s\u00e9rieux.<\/p>\n\n\n\n
