L’objet du march\u00e9 litigieux, qui inclut le traitement de donn\u00e9es \u00e0 caract\u00e8re personnel qui concernent notamment la sant\u00e9, la rend \u00ab\u00a0responsable du traitement\u00a0\u00bb de ces donn\u00e9es, au sens du RGPD. Elle est, d\u00e8s lors, responsable du respect de ce r\u00e8glement pour le traitement des donn\u00e9es \u00e0 caract\u00e8re personnel qu’elle confie \u00e0 l’attributaire du march\u00e9 (article 5 du RGPD). La question du respect du RGPD concerne, certes, l’ex\u00e9cution du contrat, mais constitue \u00e9galement une \u00ab\u00a0sp\u00e9cification technique\u00a0\u00bb du march\u00e9. De par sa nature, cette sp\u00e9cification constitue une \u00ab\u00a0exigence minimale\u00a0\u00bb \u00e0 laquelle les offres remises doivent n\u00e9cessairement satisfaire. Son respect doit, d\u00e8s lors, \u00eatre v\u00e9rifi\u00e9 par le pouvoir adjudicateur au stade du contr\u00f4le de la conformit\u00e9 des offres, avant d’attribuer le march\u00e9.<\/p>\n\n\n\n
