La circonstance que trois des quatre soumissionnaires ayant d\u00e9pos\u00e9 une offre r\u00e9guli\u00e8re se sont vu attribuer la note maximale pour les crit\u00e8res 2, 3 et 4 ne permet pas, \u00e0 elle seule, de consid\u00e9rer que ces crit\u00e8res, pr\u00e9vus par le cahier sp\u00e9cial des charges, n’auraient pas \u00e9t\u00e9 appliqu\u00e9s, voire auraient \u00e9t\u00e9 neutralis\u00e9s. Force est de relever que la note attribu\u00e9e, pour chacun de ces trois crit\u00e8res, \u00e0 chacun des soumissionnaires fait l’objet d’une motivation d\u00e9taill\u00e9e permettant de comprendre la mani\u00e8re dont chacune des offres a \u00e9t\u00e9 appr\u00e9ci\u00e9e au regard de chacun des crit\u00e8res. En outre, dans une motivation additionnelle, le pouvoir adjudicateur indique les motifs pour lesquels il lui est impossible de d\u00e9partager trois des quatre soumissionnaires sur la base des crit\u00e8res en cause. Ainsi, il est indiqu\u00e9 que chacun de ces soumissionnaires rencontre parfaitement les attentes de l’adjudicateur et que \u00ab\u00a0l’utilisation de moyens diff\u00e9rents n’emp\u00eache pas le respect desdits crit\u00e8res, sans qu’il soit possible pour l’adjudicateur de les d\u00e9partager au niveau de la cote, tant les moyens propos\u00e9s par ces trois soumissionnaires paraissent permettre une r\u00e9alisation aussi efficace du march\u00e9 en interaction avec les services de l’adjudicateur\u00a0\u00bb. Il en ressort que l’attribution de la note maximale pour trois crit\u00e8res \u00e0 trois soumissionnaires ne r\u00e9sulte pas d’un d\u00e9faut de comparaison entre les offres mais bien de la qualit\u00e9 de chacune des offres.<\/p>\n\n\n\n
