D\u00e8s lors que l’attributaire choisit librement le mode d’affichage qu’il met en oeuvre, quel que soit le montant indiqu\u00e9 dans son offre pour chaque type de vitrine et ind\u00e9pendamment de la pond\u00e9ration pr\u00e9vue dans le cahier sp\u00e9cial des charges, le crit\u00e8re d’attribution relatif au \u00ab\u00a0pr\u00e9l\u00e8vement\u00a0\u00bb, s’agissant du \u00ab\u00a0montant garanti\u00a0\u00bb, ne permet pas au pouvoir adjudicateur de juger du caract\u00e8re concurrentiel des offres et d’identifier l’offre \u00e9conomiquement la plus avantageuse, ce qui constitue l’objectif de l’article 81 de la loi du 17 juin 2016 relative aux march\u00e9s publics et de l’article 55 de la loi du 17 juin 2016 relative aux contrats de concession. Ledit crit\u00e8re semble donc devoir \u00eatre consid\u00e9r\u00e9 comme irr\u00e9gulier au regard de ces dispositions l\u00e9gales. L’irr\u00e9gularit\u00e9 en cause entra\u00eene celle du cahier sp\u00e9cial des charges et affecte la proc\u00e9dure dans son ensemble. Cette critique ne s’analyse pas comme une critique d’opportunit\u00e9 relative au crit\u00e8re concern\u00e9 et ne porte pas sur les choix qui seront faits lors de l’ex\u00e9cution du march\u00e9.
