D\u00e8s lors que le cahier des charges d\u00e9finit chaque \u00ab\u00a0poste\u00a0\u00bb comme \u00e9tant l’ensemble des prestations pour un seul ch\u00e8que, le \u00ab\u00a0prix total\u00a0\u00bb, d\u00e9fini comme \u00e9tant l’addition des trois postes, est n\u00e9cessairement la somme du prix indiqu\u00e9, pour chacun de ceux-ci, et qui porte chaque fois sur les prestations pour un ch\u00e8que. Les prescriptions du cahier des charges excluent donc la prise en compte des quantit\u00e9s estim\u00e9es pour la d\u00e9termination du \u00ab\u00a0prix total\u00a0\u00bb. Certes, des quantit\u00e9s estim\u00e9es sont mentionn\u00e9es dans le cahier sp\u00e9cial des charges, lequel pr\u00e9cise que c’est \u00ab\u00a0sur base de ces quantit\u00e9s que le soumissionnaire est invit\u00e9 \u00e0 calculer ses prix unitaires et donc \u00e0 remettre offre\u00a0\u00bb. Il n’en r\u00e9sulte donc nullement que les quantit\u00e9s pr\u00e9sum\u00e9es seraient prises en compte pour l’\u00e9tablissement du prix total au stade de l’attribution, l’objectif \u00e9tant de permettre aux soumissionnaires de d\u00e9terminer leurs prix unitaires sur la base des volumes projet\u00e9s. Les dispositions du cahier sp\u00e9cial des charges paraissent d\u00e9pourvues d’ambigu\u00eft\u00e9 et semblent devoir \u00eatre interpr\u00e9t\u00e9es comme excluant la prise en consid\u00e9ration des quantit\u00e9s pr\u00e9sum\u00e9es, la r\u00e9f\u00e9rence que fait le pouvoir adjudicateur \u00e0 l’article 86, \u00a7 4, de l’arr\u00eat\u00e9 royal du 18 avril 2017, qui a trait \u00e0 l’hypoth\u00e8se d’une modification apport\u00e9e d’initiative par un soumissionnaire aux quantit\u00e9s pr\u00e9sum\u00e9es de l’inventaire, \u00e9tant \u00e0 cet \u00e9gard d\u00e9pourvue de pertinence. A supposer que le pouvoir adjudicateur ait estim\u00e9 que, tel qu’il \u00e9tait libell\u00e9, le crit\u00e8re d’attribution relatif au prix \u00e9tait affect\u00e9 d’ill\u00e9galit\u00e9 en ce qu’il ne permet pas d’identifier l’offre \u00e9conomiquement la plus avantageuse au regard de ce crit\u00e8re, il ne lui \u00e9tait pas permis pour autant de s’\u00e9carter des prescriptions du cahier sp\u00e9cial des charges et de prendre en consid\u00e9ration les quantit\u00e9s estim\u00e9es.<\/p>\n\n\n\n
