Pour retenir l’offre comme \u00e9tant celle qui est \u00e9conomiquement la plus avantageuse, le pouvoir adjudicateur a tenu compte du rabais (ou de la ristourne) de 7.5% que proposait ce soumissionnaire en l’appliquant aux prix offerts par celui-ci pour chacun des lots 1, 4 et 5 et, en cons\u00e9quence de cette application, a identifi\u00e9 ces lots, par comparaison \u00e0 ce qu’offrait la soci\u00e9t\u00e9 requ\u00e9rante (dont la ristourne propos\u00e9e a \u00e9galement \u00e9t\u00e9 prise en consid\u00e9ration selon la m\u00eame approche), comme constituant \u00ab\u00a0l’ensemble de tous les lots \u00e9conomiquement le plus avantageux\u00a0\u00bb. Il n’appara\u00eet pas que cette mani\u00e8re de proc\u00e9der serait contraire \u00e0 la disposition de l’article 87, paragraphe 1er, alin\u00e9a 5, de l’arr\u00eat\u00e9 royal du 18 avril 2017, lue conform\u00e9ment \u00e0 ce qu’expose le rapport au Roi \u00e0 propos de l’objectif poursuivi au travers de ce mode de prise en consid\u00e9ration des rabais ou am\u00e9liorations. En outre, une fois identifi\u00e9 l’ensemble \u00e9conomiquement le plus avantageux, le pouvoir adjudicateur en a logiquement d\u00e9duit que chacun des lots formant cet ensemble devait, \u00e0 raison de cette identification pr\u00e9alable et pour ne pas priver celle-ci de sens, \u00eatre consid\u00e9r\u00e9 lui-m\u00eame comme le plus avantageux. Cette mani\u00e8re de proc\u00e9der ne m\u00e9conna\u00eet pas la r\u00e8gle de l’article 81 de la loi du 17 juin 2016, dont une modalit\u00e9 particuli\u00e8re d’application est fix\u00e9e par l’article 87, paragraphe 1er, alin\u00e9a 5, de l’arr\u00eat\u00e9 royal du 18 avril 2017, lorsqu’est en jeu l’identification de l’ \u00ab\u00a0ensemble de tous les lots \u00e9conomiquement le plus avantageux\u00a0\u00bb.<\/p>\n\n\n\n
