Il ressort de l’article 81 de la loi du 17 juin 2016 qu’est laiss\u00e9e aux pouvoirs adjudicateurs la libert\u00e9 de choix des crit\u00e8res d’attribution. Cette libert\u00e9 n’est toutefois pas illimit\u00e9e. Ainsi, les crit\u00e8res retenus doivent-ils viser \u00e0 identifier l’offre \u00ab\u00a0\u00e9conomiquement la plus avantageuse\u00a0\u00bb, sur la base du prix, du co\u00fbt ou du meilleur rapport qualit\u00e9\/prix, selon ce qu’aura choisi le pouvoir adjudicateur conform\u00e9ment \u00e0 ce que lui permet le paragraphe 2 de l’article 81. Il s’ensuit que ces crit\u00e8res doivent \u00eatre li\u00e9s \u00e0 l’objet du march\u00e9. Ensuite, un crit\u00e8re d’attribution ne peut avoir pour effet de conf\u00e9rer au pouvoir adjudicateur une libert\u00e9 inconditionn\u00e9e de choix pour l’attribution du march\u00e9, ce qui serait le cas d’un crit\u00e8re vague, al\u00e9atoire et impr\u00e9cis. Enfin, les crit\u00e8res choisis doivent respecter le principe de non-discrimination, ce qui implique qu’ils soient objectifs et indistinctement applicables \u00e0 toutes les offres. La libert\u00e9 de choix laiss\u00e9e aux pouvoirs adjudicateurs implique, par ailleurs, que, statuant sur un moyen qui met en cause le choix et la d\u00e9finition d’un crit\u00e8re d’attribution, le Conseil d’\u00c9tat ne peut substituer sa propre appr\u00e9ciation \u00e0 celle du pouvoir adjudicateur, mais bien, le cas \u00e9ch\u00e9ant, censurer l’erreur d’appr\u00e9ciation que celui-ci aurait commise en choisissant et d\u00e9finissant le crit\u00e8re contest\u00e9.<\/p>\n\n\n\n
