Il s&rsquo;agit d&rsquo;assurer l&rsquo;\u00e9galit\u00e9 entre les soumissionnaires et de ne pas valoriser, au d\u00e9triment des autres, un soumissionnaire s&rsquo;engageant sur un d\u00e9lai qui ne sera pas tenable au stade de l&rsquo;ex\u00e9cution. Une autre question est celle de savoir si,au regard de ce que pr\u00e9cisent les documents du march\u00e9, des d\u00e9lais qui seraient consid\u00e9r\u00e9s comme irr\u00e9alistes doivent amener le pouvoir adjudicateur \u00e0 \u00e9carter cette offre du fait de sa nullit\u00e9, ou, \u00e0 tout le moins, \u00e0 faire corriger cette offre. M\u00eame dans le cas des march\u00e9s vis\u00e9s \u00e0 l&rsquo;article 88 de la loi du 17 juin 2016, soumis \u00e0 un r\u00e9gime assoupli, le pouvoir adjudicateur doit, pour attribuer le march\u00e9, se fonder sur l&rsquo;offre r\u00e9guli\u00e8re \u00e9conomiquement la plus avantageuse. Le cahier sp\u00e9cial des charges pr\u00e9voit que \u00ab\u00a0au vu de son exp\u00e9rience, le pouvoir adjudicateur pourra \u00e9carter des d\u00e9lais jug\u00e9s non tenables\u00a0\u00bb. L&rsquo;offre qui propose de tels d\u00e9lais n&rsquo;est pas nulle de plein droit, mais peut \u00eatre d\u00e9clar\u00e9e nulle par le pouvoir adjudicateur, pour respecter les principes g\u00e9n\u00e9raux d&rsquo;\u00e9galit\u00e9 et de concurrence, s&rsquo;il estime que le caract\u00e8re irr\u00e9aliste des d\u00e9lais propos\u00e9s est de nature \u00e0 donner un avantage discriminatoire, \u00e0 entra\u00eener une distorsion de concurrence, \u00e0 emp\u00eacher l&rsquo;\u00e9valuation de l&rsquo;offre du soumissionnaire ou la comparaison de celle-ci aux autres offres, ou \u00e0 rendre inexistant, incomplet ou incertain l&rsquo;engagement du soumissionnaire \u00e0 ex\u00e9cuter le march\u00e9 dans les conditions pr\u00e9vues. Il convient de v\u00e9rifier si le pouvoir adjudicateur a r\u00e9guli\u00e8rement exerc\u00e9 son pouvoir d&rsquo;appr\u00e9ciation en d\u00e9cidant de ne pas consid\u00e9rer comme irr\u00e9guli\u00e8re l&rsquo;offre de l&rsquo;attributaire du march\u00e9, en raison du caract\u00e8re irr\u00e9aliste des d\u00e9lais d&rsquo;ex\u00e9cution qu&rsquo;il a propos\u00e9s. Le rapport d&rsquo;examen des offres indique qu&rsquo;il n&rsquo;a \u00e9t\u00e9 constat\u00e9 \u00ab\u00a0aucune irr\u00e9gularit\u00e9 substantielle ou non substantielle\u00a0\u00bb dans les offres remises. Cependant, ni la d\u00e9cision d&rsquo;attribution, ni le rapport d&rsquo;examen des offres, ni aucune autre pi\u00e8ce du dossier administratif ne rend compte de ce que la pouvoir adjudicateur aurait effectivement proc\u00e9d\u00e9 \u00e0 une v\u00e9rification, puis \u00e0 une appr\u00e9ciation, du caract\u00e8re r\u00e9aliste des d\u00e9lais propos\u00e9s dans les offres.
