D\u00e8s lors que ce que recouvre l’agr\u00e9ation en cat\u00e9gorie B diff\u00e8re de ce que comporte une exp\u00e9rience en mati\u00e8re de \u00ab\u00a0travaux sur un cours d’eau non navigable\u00a0\u00bb, pour \u00e9valuer utilement la capacit\u00e9 technique des soumissionnaires, le pouvoir adjudicateur a estim\u00e9 devoir compl\u00e9ter l’indication \u00ab\u00a0g\u00e9n\u00e9rale\u00a0\u00bb de capacit\u00e9 donn\u00e9e par l’agr\u00e9ation dans une cat\u00e9gorie d\u00e9termin\u00e9e de travaux, par le crit\u00e8re de s\u00e9lection contest\u00e9, en ce que celui-ci exige une exp\u00e9rience sp\u00e9cifique, appropri\u00e9e \u00e0 l’objet du march\u00e9 litigieux. En cons\u00e9quence, ce crit\u00e8re ne peut passer pour \u00eatre disproportionn\u00e9. A supposer que des travaux sur des cours d’eau navigables pr\u00e9sentent de plus grandes contraintes techniques que des travaux sur cours d’eau non navigables, la limitation des r\u00e9f\u00e9rences, pour les besoins de la s\u00e9lection qualitative dans le cadre d’un march\u00e9 d\u00e9termin\u00e9, aux seuls travaux relevant de cette deuxi\u00e8me cat\u00e9gorie ne suffit pas, en soi, \u00e0 r\u00e9v\u00e9ler le caract\u00e8re disproportionn\u00e9 du crit\u00e8re litigieux.
