D\u00e8s lors que la d\u00e9cision de la Commission europ\u00e9enne ne met pas en cause un comportement fautif imputable \u00e0 la soci\u00e9t\u00e9 intervenante, il ne peut pas \u00eatre reproch\u00e9 \u00e0 celle-ci de ne pas avoir fait \u00e9tat de cette d\u00e9cision comme \u00e9tant susceptible de l’exposer \u00e0 l’application d’un motif d’exclusion, ni, partant, de s’\u00eatre rendue coupable d’un des comportements susceptibles de justifier son exclusion en vertu de l’article 69 de la loi du 17 juin 2016. Puisqu’il ne peut \u00eatre question de fausse d\u00e9claration ou de dissimulation d’informations dont le pouvoir adjudicateur avait forc\u00e9ment connaissance, il ne peut \u00eatre reproch\u00e9 \u00e0 celui-ci ni de n’avoir pas d\u00e9cel\u00e9 des fausses d\u00e9clarations, ni de n’avoir pas sollicit\u00e9 de la soci\u00e9t\u00e9 intervenante la communication d’informations compl\u00e9mentaires. Il ne peut davantage lui \u00eatre fait grief d’avoir soumis les deux soumissionnaires \u00e0 un traitement discriminatoire, au motif qu’il aurait interrog\u00e9 la soci\u00e9t\u00e9 requ\u00e9rante \u00e0 propos de la condamnation dont celle-ci avait fait l’objet de la part de la cour d’appel, tandis qu’il s’est abstenu de le faire avec la soci\u00e9t\u00e9 intervenante \u00e0 propos de la situation dont rend compte la d\u00e9cision de la Commission europ\u00e9enne. Les circonstances entourant les situations respectives des deux soumissionnaires sont \u00e0 ce point diff\u00e9rentes qu’elles justifient que seule la soci\u00e9t\u00e9 requ\u00e9rante ait \u00e9t\u00e9 interrog\u00e9e.<\/p>\n","protected":false},"excerpt":{"rendered":"
