Cette disposition entend concilier l’imposition de sp\u00e9cifications techniques par les acheteurs publics et l’ouverture des march\u00e9s publics \u00e0 la concurrence, en exigeant des sp\u00e9cifications techniques qu’elles soient suffisamment transparentes et non discriminatoires. Les sp\u00e9cifications techniques doivent donner aux op\u00e9rateurs \u00e9conomiques \u00ab\u00a0une \u00e9galit\u00e9 d’acc\u00e8s \u00e0 la proc\u00e9dure de passation et ne peuvent avoir pour effet que des obstacles injustifi\u00e9s \u00e0 l’ouverture des march\u00e9s publics \u00e0 la concurrence soient soulev\u00e9s\u00a0\u00bb.
