Pour r\u00e9pondre aux besoins de ses adh\u00e9rents en mati\u00e8re de services postaux, le pouvoir adjudicateur a choisi de concevoir le march\u00e9 litigieux en d\u00e9finissant l’objet de celui-ci par r\u00e9f\u00e9rence \u00e0 la notion de \u00ab\u00a0service postal universel\u00a0\u00bb au sens qu’en donne l’article 15 de la loi du 26 janvier 2018 relative aux services postaux. En tant que telle la l\u00e9galit\u00e9 de la d\u00e9cision d’assigner au march\u00e9 litigieux un objet d\u00e9fini notamment par r\u00e9f\u00e9rence au \u00ab\u00a0service postal universel\u00a0\u00bb n’est pas mise en cause par le moyen, dont les d\u00e9veloppements paraissent devoir \u00eatre compris comme critiquant l’obligation d’utilisation cumulative des deux modes d’affranchissement, en tant que cette obligation serait une modalit\u00e9 d’ex\u00e9cution du march\u00e9. Si les d\u00e9veloppements de la requ\u00eate doivent se comprendre comme critiquant la l\u00e9galit\u00e9 de l’objet d’un march\u00e9 portant sur une prestation de services \u00ab\u00a0limit\u00e9e aux seuls prestataires de services postaux universels\u00a0\u00bb, cette limitation et la restriction de la concurrence \u00e0 ces seuls prestataires sont affirm\u00e9es sans plus par la soci\u00e9t\u00e9 requ\u00e9rante. \u00c0 la lecture de l’expos\u00e9 du moyen, il appara\u00eet que le grief caus\u00e9 \u00e0 la requ\u00e9rante par cette obligation d’utilisation cumulative consisterait \u00e0 ne pas lui permettre de faire offre sur la base du mod\u00e8le de r\u00e9mun\u00e9ration qu’elle d\u00e9crit comme \u00e9tant celui d’un prestataire de services de routage, mod\u00e8le impliquant selon elle un affranchissement par le prestataire de services, et non un pr\u00e9-affranchissement par l’entit\u00e9 adh\u00e9rente. Cet inconv\u00e9nient r\u00e9sulte en r\u00e9alit\u00e9 des documents du march\u00e9. La l\u00e9sion dont fait \u00e9tat la requ\u00e9rante n’appara\u00eet donc, prima facie, pas \u00eatre celle que causerait l’ill\u00e9galit\u00e9 de l’obligation l’utilisation cumulative mise en cause par le moyen, mais celle qui r\u00e9sulterait du recours plus g\u00e9n\u00e9ral au pr\u00e9-affranchissement par l’entit\u00e9 adh\u00e9rente, prescription que la requ\u00e9rante ne critique pas en tant que telle.<\/p>\n","protected":false},"excerpt":{"rendered":"
