L’article 13, paragraphe 2, de la loi du 17 juin 2016, auquel renvoie l’article 10 de la loi du 17 juin 2013, pr\u00e9cise que l’interdiction de divulgation des \u00e9l\u00e9ments communiqu\u00e9s \u00e0 titre confidentiel s’impose \u00e0 l’adjudicateur \u00ab\u00a0sans pr\u00e9judice des obligations en mati\u00e8re de publicit\u00e9 concernant les march\u00e9s publics attribu\u00e9s et l’information des candidats, des participants et des soumissionnaires\u00a0\u00bb. Les \u00e9l\u00e9ments de prix qui figurent dans le rapport d’analyse des offres et dans la premi\u00e8re d\u00e9cision d’attribution des lots 1 et 3 du march\u00e9 pouvaient \u00eatre communiqu\u00e9s aux diff\u00e9rents soumissionnaires, en application des articles 4, 8\u00b0, 5, 9\u00b0 et 8, 3\u00b0, de la loi du 17 juin 2013, pour les informer des motifs pour lesquelles leurs offres n’avaient pas \u00e9t\u00e9 choisies \u00ab\u00a0en ce compris les caract\u00e9ristiques et les avantages relatifs de l’offre retenue\u00a0\u00bb. Les prix totaux de l’offre de la soci\u00e9t\u00e9 requ\u00e9rante sont d\u00e9sormais connus de ses concurrents. Cependant, dans le cadre de la nouvelle proc\u00e9dure de passation, les lots de ce march\u00e9 seront attribu\u00e9s sur la base d’autres sp\u00e9cifications, ce qui aura une influence sur les prix.
