L’article 6 de la loi du 17 juin 2016 impose d’une part, au pouvoir adjudicateur de prendre les dispositions n\u00e9cessaires afin de pr\u00e9venir toute situation de conflit d’int\u00e9r\u00eats et, d’autre part, \u00e0 toute personne li\u00e9e \u00e0 un adjudicateur se trouvant dans une situation de conflit d’int\u00e9r\u00eats de se r\u00e9cuser. Il ne semble prima facie exister aucune disposition l\u00e9gale ou r\u00e9glementaire pour interdire aux personnes morales qui pr\u00e9sentent des liens structurels avec l’autorit\u00e9 de se porter candidates pour des march\u00e9s publics attribu\u00e9s par celle-ci.
