La soci\u00e9t\u00e9 requ\u00e9rante ne pouvait ignorer que le crit\u00e8re du prix serait divis\u00e9 en deux sous-crit\u00e8res et que les prix remis pour les deux tableaux de l’annexe 3 feraient l’objet d’une \u00e9valuation pour d\u00e9terminer l’offre \u00e9conomiquement la plus avantageuse. Elle a d’ailleurs interrog\u00e9 la partie adverse \u00e0 ce sujet. Ceci \u00e9tant, les soumissionnaires ne pouvaient pr\u00e9voir qu’un poids \u00e9quivalent serait n\u00e9cessairement reconnu \u00e0 chacun des deux sous-crit\u00e8res du prix. Le choix de cette pond\u00e9ration n’appara\u00eet pas a priori comme \u00e9vident. Rien dans les documents du march\u00e9 ne laissait pressentir qu’une pond\u00e9ration 50\/50 permettrait n\u00e9cessairement d’identifier l’offre la moins-disante. Tout d\u00e9pend de l’importance relative des deux postes et, pour ce qui concerne le march\u00e9 en cause, du volume estim\u00e9 de copies r\u00e9alis\u00e9es mensuellement par machine. Dans sa note d’observations, le pouvoir adjudicateur soutient que cette pond\u00e9ration \u00e9tait pr\u00e9visible d\u00e8s lors qu’elle ne pouvait se limiter \u00e0 additionner les prix globaux et les prix unitaires figurant dans les offres. Ceci ne permet cependant pas de d\u00e9montrer qu’une pond\u00e9ration 50\/50 devait logiquement \u00eatre appliqu\u00e9e, \u00e0 d\u00e9faut de toute autre pr\u00e9cision contenue dans le cahier sp\u00e9cial des charges et ses annexes et en l’absence de r\u00e9ponse claire fournie par le pouvoir adjudicateur aux questions pos\u00e9es par les soumissionnaires.<\/p>\n","protected":false},"excerpt":{"rendered":"
