\u00ab La Cour d\u2019appel de Gand vient de juger que la vente de 79 terrains agricoles par le CPAS de Gand \u00e9tait contraire au principe d\u2019\u00e9galit\u00e9, dans la mesure o\u00f9 cette vente \u2013 fond\u00e9e sur le crit\u00e8re \u00ab prix \u00bb \u2013 \u00e9tait conditionn\u00e9e au fait d\u2019acqu\u00e9rir les 79 terrains en un seul lot. La Cour constate que, ce faisant, le CPAS a limit\u00e9 la concurrence en emp\u00eachant \u00e0 des candidats acqu\u00e9reurs de moindre importance de faire offre et que cette vente en un seul lot r\u00e9duit le prix que le CPAS pouvait esp\u00e9rer de cette vente. La Cour consid\u00e8re qu\u2019il y a potentiellement une aide d\u2019\u00e9tat en faveur de l\u2019acqu\u00e9reur de ces terrains puisque celui-ci a b\u00e9n\u00e9fici\u00e9 d\u2019un terrain public \u00e0 des conditions avantageuses et s\u00e9lectives. La Cour a donc saisi la Commission europ\u00e9enne en vue de lui demander un avis sur cette question. L\u2019irrespect des principes d\u2019\u00e9galit\u00e9, transparence et non-discrimination dans les contrats publics est donc rappel\u00e9 par la Cour d\u2019appel de Gand, laquelle consid\u00e8re que cela peut indirectement g\u00e9n\u00e9rer une aide d\u2019\u00e9tat ill\u00e9gale en faveur de l\u2019entreprise favoris\u00e9e. \u00bb<\/p>\n","protected":false},"excerpt":{"rendered":"
