Il pr\u00e9sentera un expos\u00e9 sur \u00ab\u00a0l\u2019obligation europ\u00e9enne de transparence\u00a0\u00bb, \u00e0 savoir l\u2019application des principes d\u2019\u00e9galit\u00e9, transparence et non-discrimination aux actes unilat\u00e9raux et contrats, qui ne sont pas des march\u00e9s publics, et qui sont pass\u00e9s par les autorit\u00e9s publiques et autres entit\u00e9s dirig\u00e9es, financ\u00e9es ou contr\u00f4l\u00e9es majoritairement par les pouvoirs publics. A l\u2019issue de cette \u00e9tude, il constate que de tr\u00e8s nombreux actes unilat\u00e9raux (autorisations, subsides, etc) ou bilat\u00e9raux (contrats immobiliers, concessions domaniales, etc) sont soumis \u00e0 un r\u00e9gime de concurrence, que ces actes \u00e9manent d\u2019autorit\u00e9s administratives pures ou d\u2019entit\u00e9s para-publiques. <br>De plus, d\u00e8s lors que ces obligations ne sont pas respect\u00e9es, la nullit\u00e9 des actes ill\u00e9gaux peut \u00eatre invoqu\u00e9es en justice par les tiers.
